Online poker is technically illegal in Myanmar under the country's gambling laws. The 2019 Gambling Law permits certain forms of gambling under specific conditions, but an implementing framework including a proper licensing system has not yet been developed (1). This leaves online poker and other internet gambling activities in a legal gray area, with the government not actively enforcing prohibitions against online gambling participation.
Land-based poker falls under Myanmar's general gambling restrictions, though the 2019 Gambling Law allows casinos to operate if they cater exclusively to foreigners. The Pyidaungsu Hluttaw enacted The Gambling Law on May 7, 2019, defining a casino as any location registered with Union Government approval where only foreigners shall be allowed to gamble (1). Myanmar nationals are strictly prohibited from entering casinos and participating in gambling activities under current regulations.
"Following several discussions on significant changes being proposed in Myanmar in relation to the gambling landscape, the Pyidaungsu Hluttaw (Myanmar parliament) finally enacted The Gambling Law on 7 May 2019."
The Union Government holds authority to screen and allow casino establishments according to stipulations outlined in the law. Myanmar's gambling regulations carry penalties ranging from six months to five years imprisonment, along with fines up to 1 million kyat for violations (2). Township Administrators, Township Police officers, and Station Officers possess powers to conduct searches, seizures, and arrests without warrants for gambling law violations.
