Online poker operates in a legal gray area in Namibia, as there is no specific licensing framework for internet-based gambling. The Gaming and Entertainment Control Act 2018 came into force in December 2021 and strictly prohibits unlicensed online gambling (1). However, the government minister responsible for gambling must develop policies on online games that will be allowed, and the Gambling Board will process licenses accordingly.
Land-based poker is legal in licensed casinos and gambling houses under the Casinos and Gambling Houses Act (Act 32 of 1994). The Gaming Control Division, governed by this Act, makes provision for the licensing, supervision and control of casinos and gambling houses (2). As of November 2016, Namibia had issued six casino licenses and 254 gambling house licenses throughout the country.

The Gambling Board enforces gambling regulations, processes licenses, and maintains a registry of restricted players under the Gaming and Entertainment Control Act 2018. The Ministry of Environment, Tourism and Forestry oversees Namibia's gaming control division (2). Breaches of gambling laws, including offering illegal or unlicensed gambling, can result in up to ten years imprisonment and fines under current legislation.
