Poker is legal in Kenya and regulated under the Betting, Lotteries and Gaming Act. The Betting Control and Licensing Board was established by Section 3(1) of the Act Cap 131 Laws of Kenya in 1966 as the primary regulatory body responsible for issuing and renewing licenses for gambling activities. Poker falls under the category of public gaming, which includes casinos and activities such as table games including poker, blackjack, baccarat and roulette (1).
Licensed casino operators in Kenya can offer poker in their establishments after obtaining proper authorization from the BCLB. Public gaming refers to casinos and the activities carried out therein such as slot machines and table games. Casino gaming means any and all table and casino-style games played with cards including poker, which is specifically authorized by the Board as a wagering game under the legislation (2).
"The Betting Control and Licensing Board is a regulatory body whose mandate is drawn from the Act that provides for the control and licensing of betting and gaming premises and the activities carried therein."
To operate poker legally in Kenya, operators must meet extensive licensing requirements including substantial application fees and investigation fees. The application fee for public gaming is Kshs 1,000,000, with a license grant fee of Kshs 3,000,000 and an annual fee of Kshs 500,000. The board ensures that all licensed betting companies comply with the provisions of the Act and its regulations, promoting responsible gambling and preventing gambling-related harm (2).
