Online poker is illegal in Thailand under the Gambling Act B.E. 2478, confirmed in 1935. The law bans almost all types of virtual gambling except for state lottery and horse racing, provided they are licensed (1). The Criminal Code prohibits organizing and promoting poker games online in the country, with violations resulting in harsh penalties including imprisonment for organizers, while participants face legal prosecution, although such cases remain relatively rare.
The Thai government is preparing to legalize online gambling, marking a significant shift in regulating an industry that has long operated underground. The plan aims to replace the unregulated gambling market with a transparent and secure legal framework where operators adhere to strict guidelines and taxation rules, with revenue reserved for public welfare projects (2). However, legalization requires amending minister-created secondary laws before major laws can be changed, a process requiring Parliamentary approval.
"The government's proposal to legalize online gambling is centered on creating a well-regulated environment for digital gaming. The plan aims to replace the unregulated underground gambling market running rampant online."
In July 2025, Thailand lifted its decades-old poker ban when the Interior Ministry revoked the 1958 directive restricting poker, recognizing it as a sport rather than gambling (1). Poker events are only legal if they meet specific criteria, including international tournaments, clearly defined rules, and oversight from licensed associations. Until the Poker Sports Association becomes operational and official regulations are implemented, no casual or private poker games are permitted, with events strictly non-betting in nature.
