Online poker is legal in Peru following the enactment of Law No. 31,557 in August 2022, which established a comprehensive regulatory framework for remote gaming and sports betting. President Pedro Castillo signed the legislation after it received overwhelming approval from Congress with 91 votes in favor and no opposing votes (1). The law became effective 60 days after its publication in Peru's official newspaper, El Peruano, marking a significant shift toward regulated online gambling in the country.
The Ministry of Foreign Trade and Tourism of Peru, known as MINCETUR, serves as the country's official gambling regulator with broad enforcement powers. MINCETUR is responsible for monitoring all gambling activities, including the authority to block unauthorized URL and IP addresses that violate the law (1). The regulatory body also ensures that all technological software and hardware used for online gambling operations meet proper working standards and compliance requirements.

Licensed operators offering online poker and other gambling services must comply with strict taxation and operational requirements under Peruvian law. The government imposes a 12% tax on net winnings, calculated as total bets minus prizes paid out, along with a 1% Selective Consumption Tax on each wager placed (2). Operators are required to establish a legal presence within Peru, maintain responsible gambling measures including deposit limits and self-exclusion options, and implement comprehensive anti-money laundering procedures as classified obligated subjects under Peru's financial intelligence framework.
